Terms of sale and delivery for Austria and other foreign countries

Valldity

Our deliveries and accomplishments exclusively take place according to our business conditions. These conditions are valid for all, business relations too, without further express agreement. Any purchasing conditions of the buyer well hereby revoked,

Prices

Essential are our lists, which are valid at the time of delivery for native country -Europe - EFTA countries and overseas.

Responsibility

The buyer is responsible for the merchandise as soon as the merchandise will be handed over to the forwarding agent. This is valid for agreement at delivery free of charge too.

Reservation of property

In case of a deportment of the buyer contrary to the contract - especially in case of daly in payment - we are entitled to take back the reserve merchandise to the debit of the buyer or in such a case to demand the asslgnment of the Claim of delivering of the buyer against a third person. Concerning the taking back as well as the distress of the reserve merchandise It's only a case of a retreat of the contract if it would be expressly declaired by a letter of us.

Payment

Our invoices have to be paid in advance with 3 % discount, plus freight, plus 1 % breakage. Our prices are net prices. Beginning of the limited period is the date of invoice. The minimum of an order is Euro 250,- . For an order about Euro 1 .000,- delivery franco german frontier.

Freight rates for Austria

The freight rates for the other foreign countries are calculated to their volume and the value of order.

Notice of defects

Information according 377, 378 HGB is only happened without delay, if we receive this information latest 4 days after delivery of the merchandise by phone or fax.

Guarantee

If there is defectiveness of the merchandise we are authorized to make a compensation delivery. The buyer is able to demand a reduction in price or to cancel the contract of sale when the compensation delivery go wrong too. Claim to compensation because of impossible accomplishments delay and because of fault at formation of contract and forbidden business are excluded, except when it is based on purpose or gross negligence.

Application of the right

For all relations of right to the buyer, only the right of the Federal Republic of Germany has validity.
